1. Copyright
No images can be reproduced, downloaded or printed from this website. It is an infringement of copyright. All images are covered by the ‘Copyright’ law, both nationally and internationally.
No cropping, addition, alteration to or adaptation of a picture may be made unless a written agreement permits otherwise
2. The client
The client is authorized to use the images in any way as per the agreements made between the client and the photographer.
The client consents to their children being photographed. It is the client’s responsibility to gain written agreement if they don’t want the images of persons under the age of sixteen years to be used in anything other than the purpose for which they were photographed. In the event of a birthday party for example, the client is responsible for all children that may be photographed.
The client is responsible for all the necessary clearances to allow the photographs to be taken without obstruction or infringements.
The client will receive the images after full payment is made.
The client will receive the images digitally and should they want extra digital copies of the images they will have to pay an extra fee of 20AUD. This fee covers the extra photos, time, effort and materials required to deliver the CD.
Images will only be handed to the client themselves not a third party unless the relevant client has notified otherwise. The photographer will not be responsible for any loss or damage caused by a third party.
In the event that a client loses images previously shot and supplied to deadline and in accordance to the agreement, it is possible for them to re-order. A same 20AUD fee will be chargeable for the duplication of a CD/DVD.
The client agrees to not hold the photographer liable for the deterioration of any hardcopy of the photographs. We understand that photographs are susceptible to environmental affects that will limit their longevity.
The client agrees that all prints and image files provided to them are licensed for personal use only.
Images or part of an image are not to be published for advertising or promotional purposes without written consent.
RAW material can be given out to the client at a flat fee of 500AUD and client will be given the right to use and modify the original material as their own.
3. The Photographer
The photographer retains the right to use the photographs in any manner at any time for the purposes of advertising or otherwise promoting his work unless agreed otherwise by written agreement.
The photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to him/her in confidence for the purposes of the photography.
Should the photographer not be available for any valid reason, the photographer will notify the client of the change as soon as it is known and provide another photographer of equivalent skills or provide a full refund. The photographer holds no liability on the alternative action.
The photographer will not give out the original RAW files of the images and will only keep these files for a period of 6 months following the delivery of the first copy. After this period the photographer will no be held responsible for any loss or damage of images.
4. Payment
A booking is considered firm as from the date of confirmation and accordingly the photographer will charge a non-refundable booking fee of 25% off the total amount.
A cancellation or postponement fee will be charged if the client does not give reasonable notice, here 7 business days. Without reasonable notice the photographer will charge 10% of the total amount.
The client will make full payment within 30 days of the issue of the relevant invoice. If the invoice is not paid within this period of time the photographer reserves the right to charge interest at the rate of 10AUD/day from the date the payment was due until the date payment is made.
Where extra expenses or time are incurred by the photographer as a result of alterations to the original brief by the client, the client shall give approval to and be liable to pay such extra expenses or fees at the photographer’s normal rate in addition to the expenses agreed or estimated.
Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style or composition.
